1. Acceptance of Terms

By downloading, accessing, or using the Deal Hunters mobile application (the “App”), you agree to be bound by these Terms of Use (the “Terms”). If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 13 years of age (or the age of majority in your jurisdiction, if older) to use Deal Hunters. By using the App, you represent that you meet these requirements and have the legal capacity to enter into this agreement.

3. User Accounts

1. Registration: To access certain features, you may be required to create an account. You must provide accurate, current, and complete information and keep it updated.
2. Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
3. Termination: We reserve the right to suspend or terminate your account at any time, for any reason, including if we suspect that you have violated these Terms.

4. User Conduct

When using the App, you agree not to:

1. Post or share any content that is unlawful, harmful, offensive, or violates any third-party rights.
2. Use the App for illegal activities or to promote any illegal activities.
3. Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
4. Engage in spamming, phishing, or any fraudulent activity.
5. Circumvent or attempt to circumvent any security feature of the App.

5. User-Generated Content

1. Ownership: You retain ownership of the content you post, including deals, comments, and images. However, by posting content, you grant Deal Hunters a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content in connection with the Services.
2. Responsibility: You are solely responsible for the content you post and any consequences arising from it. Deal Hunters does not endorse or assume any liability for user-generated content.
3. Removal: We reserve the right to remove or modify any content at our discretion, without prior notice.

6. Intellectual Property

1. Our Materials: All content, trademarks, service marks, logos, and other intellectual property displayed in the App (except user-generated content) are owned by Deal Hunters or our licensors. You may not use our intellectual property without our prior written consent.
2. User License: Subject to your compliance with these Terms, Deal Hunters grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial purposes.

7. Affiliate Links and Third-Party Services

1. Affiliate Links: Deal Hunters may include affiliate links in shared deals. We may earn a commission if you make a purchase through these links.
2. Third-Party Content: The App may contain links to third-party websites, apps, or services that are not owned or controlled by Deal Hunters. We are not responsible for the content, policies, or practices of any third-party services.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DEAL HUNTERS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF ANY CONTENT OR DEALS PROVIDED THROUGH THE APP.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEAL HUNTERS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE APP.

10. Indemnification

You agree to defend, indemnify, and hold harmless Deal Hunters, its affiliates, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App, your user-generated content, or your violation of these Terms.

11. Modifications to the App and Terms

We reserve the right to modify or discontinue the App at any time, with or without notice. We may also revise these Terms from time to time. Any changes will be effective immediately upon posting of the revised Terms in the App. Your continued use of the App after such changes have been posted constitutes your acceptance of the new Terms.

12. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of São Paulo, Brazil, without regard to its conflict of law principles. Any claims or disputes arising from your use of the App shall be resolved exclusively in the state or federal courts located in [that jurisdiction], and you consent to the personal jurisdiction of such courts.
